Welcome to WILDhue Limited’s Terms Of Service. By accessing or using our website, you agree to comply with the following terms and conditions. If you disagree with any part of these terms, please refrain from using our website.


1. Overview

1.1 These terms and conditions, along with our ‘Privacy’, ‘Shipping’ & ‘Returns & Exchanges’ Policies, regulate your use of the WILDhue website and the purchase of any goods through it. By accessing, browsing, or ordering from our website, you accept these terms and conditions.

1.2 This document, together with our ‘Privacy’, ‘Shipping’ and ‘Returns & Exchanges’ Policies are readily available on our website and provide you with information about us and the legal terms under which we sell products listed on our website. On you making a purchase from WILDhue, these terms form a contract between us as the seller and you as our customer. Please read all terms carefully before ordering any products from www.wildhue.co.nz. By ordering our products, you agree to these terms and any associated documents referred to.

1.3 We periodically update these terms. The most recent amendment date is noted at the top of this page. Each time you purchase products from us, please review the terms before proceeding.


2. Information on our Website

2.1 All intellectual property rights related to the website, our social media pages, or physical documentation belong to or are licensed to WILDhue. You may not use any intellectual property or reproduce any of our material digital or physical without written permission from the management of WILDhue Limited.

2.2 Our product information is based on and provided by third-party suppliers and may contain inaccuracies. WILDhue is not responsible for such errors except as required by law. Links to third-party sites or resources are provided for your information only, and we have no control over their content. It is your decision whether to access these links or resources.

2.3 We may update our website and change its content without notice. If any of our content is out of date, we apologise for the inconvenience, please notify us at your will, however note that we are not obligated to update it. We do not guarantee that our site or any content on it will be free of errors or omissions.

2.4 WILDhue does not guarantee that our site or its content will always be available or uninterrupted. Access is permitted temporarily and is free of charge.  Please note that we may suspend, withdraw, discontinue, or change all or any part of our site without notice. We are not liable if our site is unavailable at any time or for any period. You are responsible for making all arrangements necessary to access our site. You are also responsible for ensuring that all persons who access our site through your internet connection comply with these terms of use and other applicable terms and conditions.

2.5 We cannot guarantee that our website is secure or free of bugs or viruses. You are responsible for maintaining your technology with current virus protection software. Misuse of our site by introducing viruses or other harmful material is prohibited. Unauthorised access to our site, server, computer, or databases will be reported to law enforcement authorities, and your right to use our site will cease immediately upon breach of these terms.


3. Website Use and Access

3.1 Your use of the website must comply with our terms and conditions and all applicable laws.

3.2 Actions considered prohibited activities:

  • Encouraging or committing a criminal offence/s.

  • Interfering with WILDhue’s or third parties associated with our website, servers, or networks hosting the website.

  • Misuse of data or extraction from the website against our approval.

  • Interfering with security features of the website.

3.3 To access certain features of our website or place an order, you must register an account and:

  • Be over 18 years old and authorised to use the selected payment method you have chosen.

  • Provide accurate and current personal information to be able to process your order.

  • Register only one account per individual and/or email using the site.

3.4 You are responsible for all activities you undertake on your account and must keep your password secure at all times. If you suspect unauthorised or fraudulent use, please contact hello@wildhue.co.nz immediately.

3.5 WILDhue does not guarantee uninterrupted website availability or the accuracy of websites linked to our site.

3.6 You must not link to the website or WILDhue’s social pages in a way that damages or exploits WILDhue's reputation.

3.7 We handle your personal information according to our Privacy Policy. Please read it as it contains important information relevant to you.


4. Orders

4.1 Please follow the website instructions to place an order. Our order process allows you to check and correct any errors before submitting your final order. Please review your order carefully at each stage to complete your purchase and delivery of your order.

4.2 Order confirmation emails acknowledge receipt but do not constitute acceptance. An agreement is formed upon receipt of a shipment confirmation email. WILDhue may refuse orders for various reasons, including stock unavailability or suspected fraud.

4.3 Acceptance of your order is issued when you receive an email confirming that your order has been dispatched. The contract between us becomes final at that point. If an order is cancelled before dispatch confirmation, any payment made will be refunded, subject to incurred bank fees. We cannot retrieve an order after it has been sent to our courier.

4.4 If we are unable to supply a product, we will refund the full or part amount as soon as possible.

4.5 WILDhue may cancel orders at any time, providing notice and refunding any payment made by you.


5. E-Gift Cards

5.1 E-Gift cards can be used only for payment on www.wildhue.co.nz. They are non-transferable, non-refundable, and cannot be exchanged for cash, a physical gift card, or credited to an account.

5.2 Remaining balances can be used for future purchases before the expiry date.  The expiry date is 24 months from the purchase date. 

5.3 You are responsible for the safety of your e-gift card. WILDhue is not liable for lost, stolen or unauthorised use of e-gift cards.

5.4 E-gift cards cannot be purchased using third-party services such as Afterpay. Credit and debit cards are the only acceptable forms of purchase for e-gift cards on our site.


6. Price and Payment

6.1 The final price shown at checkout includes taxes and delivery fees.

6.2 All charges are in New Zealand dollars unless stated otherwise.

6.3 Payment must be made in full at the time of ordering using accepted methods listed at checkout (e.g. authorised credit card, gift card, store credit, debit card and/or Afterpay). WILDhue is not responsible for decisions made by third-party payment providers or anyone who uses your payment means without your consent.


7. Voucher Codes, Promotions and/or Discounts

7.1 Promotion and voucher codes are valid for specified periods and contain conditions around their use.  They are not able to be redeemed for monetary value or cash.  We allow one product discount code to be used per order.  Some codes may not be redeemable on certain products and delivery amounts.  

7.2 Any refunds issued using a discount code will be refunded to your means of purchase at the discounted amount.

7.3 We reserve the right to cancel codes if they’re being misused without notice.  

7.4 The 10% discount code on the Welcome Email is valid for one order only and can only be used once per customer. This is inclusive of GST and cannot be combined with other product discount codes.

7.5 Promotional codes, including Hide and Seek codes, are subject to a limited quantity as specified in the promotional announcements. Once the allotted number of codes has been reached, they will no longer be available for use. These codes will remain visible on WILDhue’s website until the promotion concludes, after which they will be removed. We are not responsible for any misuse of the codes. The Hide and Seek promotions are designed purely for entertainment and to offer discounts to our customers.

7.6 Groomsmen deal: The discount applies to the lower-priced bow tie in the purchase. Offer valid for adult bow ties only. Deal available from 22nd–31st January 2025. This promotion can be combined with our spend $150 & get free shipping offer. Cannot be combined with other discounts or promotions.


8. Our Products

8.1 Images of products on our website are for illustrative purposes only. We cannot guarantee that your screen accurately reflects the product colours, so actual products may vary slightly from the images displayed.  Should you be not happy with your product on delivery please follow our Returns & Exchanges Policy.

8.2 All products shown on our site are subject to availability.  We endeavour to keep our stock up to date at all times, however, we can’t guarantee stock levels due to computer issues and/or human error.  Although we strive to maintain accurate stock counts, discrepancies may occur. We will communicate with you to arrange a suitable solution if this happens.


9. Ownership of Goods

9.1 Ownership transfers to you as the customer upon full payment.

9.2 This contract is between you and WILDhue. No other person has the right to enforce its terms unless you transfer your contract to another person with our written agreement.


10. Shipping and Risk

10.1 Delivery times are indicative. Please refer to our ‘Shipping’ Policy for more information on shipping timeframes and 'Returns & Exchanges' Policy for returns information. WILDhue is not liable for delays.

10.2 WILDhue will attempt delivery to the address provided by you when ordering from us. Refusal to accept delivery may result in additional charges or contract termination.  Please make sure the address is correct at all times.

10.3 Risk transfers to you upon delivery to the courier partner.

10.4 Export/import documentation and costs are your responsibility if purchasing from outside New Zealand.

10.5 We do not deliver to PO Boxes or Private Bags.

10.6 For international shipping (excluding Australia and USA), please email us for a shipping quote. Australia has a flat rate of NZD $15 for postage. USA has a flat rate of NZD $30 for postage.

11. Returning Goods

11.1 Claims for damaged or incorrect goods must be made within 14 days of payment.

11.2 Goods must be returned in original condition, with all labels and original packaging. WILDhue covers return costs for damaged goods only, unless otherwise agreed.  

11.3 Returns will be refunded to the means of payment used only unless otherwise agreed due to damaged goods. WILDhue is not required to give cash refunds for change-of-mind or wrong size purchases. If buying as a gift, we recommend buying a gift card as we do not offer exchange cards only refunds.

11.4 No returns for sale items, used goods, or goods without original labels or packaging.

11.5 Details of your right to return products are provided in our ‘Returns & Exchanges’ Policy.


12. Liability

12.1 WILDhue's liability is limited to the extent permitted by law.  If you think we have failed to comply with our terms, we are not responsible for any loss or damage that was not foreseeable by us.

12.2 For non-WILDhue branded goods, WILDhue excludes liability for related claims.

12.3 Total liability depends on the value of the goods in question.

12.4 Consumer guarantees under applicable laws are not excluded or limited.

12.5 We supply our products for private use only. The customer agrees not to use our products for any commercial business or resale purpose, and WILDhue has no liability to you for any loss of business and/or profit or business interruption caused.


13. Force Majeure

13.1 WILDhue is not liable for delays or failures caused by events beyond its control.

13.2 An Event beyond our control includes, but is not limited to: any act or event beyond our reasonable control, including strikes, civil commotion, riot, terrorist attack, war, fire, explosion, storm, flood, earthquake, epidemic, or failure of public or private telecommunications networks.

13.3 If an Event Outside Our Control affects our obligations under the contract, we will notify you as soon as possible. Our obligations will be suspended, and the time for performance will be extended for the duration of the event outside our control.  If any packages have been affected by the event, we will endeavour to deliver these as soon as possible or communicate with you regarding a solution.


14. Indemnity

14.1 You agree to indemnify and hold WILDhue harmless from any claims arising from your breach of these terms or violation of any laws or third-party rights.


15. Termination

15.1 WILDhue reserves the right to terminate these terms in cases of breaches or insolvency with no notice period.

15.2 Upon termination, WILDhue retains the discretion to handle goods as it sees fit.


16. Our Right to Amend these Terms

16.1 We may revise these terms periodically. Any orders placed after such amendments will be subject to the new terms. Each time you order products from us, the terms in force at that time will apply to the contract between you and us. 

16.2 Changes may include how we accept payments, delivery, shipping information, pricing, and compliance with current laws and regulations. 

16.3 The date of the last amendment is indicated at the top of this page.


17. Governing Law

17.1 These terms are governed by the laws of New Zealand, and any disputes will be subject to the exclusive jurisdiction of New Zealand courts.


18. Severability

18.1 If any clause of these terms is found to be illegal or unenforceable, the remaining clauses will remain in full effect.


19. Disputes

19.1 Any disputes should be initially addressed through negotiations with WILDhue's management team. Please contact us at hello@wildhue.co.nz if you have a dispute or formal complaint. We aim to resolve all issues before any complaints are made public on our site or social media.


20. Communications

20.1 For any inquiries, please contact us at hello@wildhue.co.nz. We will respond within 7 business days.


21. Competitions

21.1 Entry dates and eligibility criteria may be modified without prior notice. 

21.2 Employees and their immediate families are not eligible to participate. 

21.3 The decisions of the judges are final. 

21.4 Reasonable attempts will be made to contact the winner/s.  Should such a prize not be claimed within 48 hours of notification, the prize will be withdrawn or redrawn.  WILDhue reserves the right to proceed how it sees fit.

21.5 Prizes are final and cannot be exchanged for cash or store credit unless otherwise agreed.

21.6 Social Media Tag Us Entries: Each account can win a $50 voucher competition only once. Accounts will be verified for legitimacy before any prize is awarded. Winners are contacted via email.  We will pick a winner every 6 months in February and August each year.  The more tags you do the more entries you receive - 1 tag = 1 entry.

21.7 Terms and Conditions for our Instagram Competition
Competition Name: Black Friday: Win a $100 Prezzy Card 

1. Eligibility:
This competition is open to all Instagram users who are 18 years or older. The winner must be following our Instagram account @wildhue.nz.

2. Entry Requirements:
To enter, participants must:

-  Like WILDhue on Instagram

- Share WILDhue's Black Friday Sale reel to their Instagram story
- Tag @Wildhue.nz in the above Instagram story

3. Competition Period:
The competition begins on Friday 22nd November and ends on December 8th at 12:00 PM (NZST). Entries submitted after this time will not be considered.

4. Prize:
One winner will receive a $100 Prezzy Card. The prizes are non-transferable and cannot be exchanged for cash. 

5. Winner Selection:
The winner will be randomly selected from all valid entries on Instagram and will be announced on our socials on December 10th. 
There is only one winner from Instagram. 

6. Notification:
The winner will be contacted via direct message on Instagram. If the winner does not respond within 48 hours, a new winner will be selected.

7. General Conditions:
By entering, participants agree to abide by these terms and conditions. The competition is not sponsored, endorsed, or administered by Instagram or Facebook. 

8. Privacy:
Participants’ personal information will only be used for the purpose of this competition and will not be shared with third parties.

9. Amendment:
We reserve the right to amend these terms and conditions or cancel the competition at any time without prior notice.

10. Acceptance of Terms:
By participating in this competition, you confirm that you have read, understood, and agreed to these terms and conditions.

22. Price of Products and Delivery Charges

22.1 Product prices are as quoted in New Zealand dollars on our site, unless the user has selected a different currency themselves on entry to the site. We take care to ensure prices are correct. If we/you find an error in the price of the products you ordered, please contact us or we will contact you to rectify.

22.2 Prices for our products may change without notice, but such changes will not affect any confirmed order. 

22.3 Product prices do not include delivery charges. Delivery charges are quoted on our site under the ‘Shipping’ Policy.  

22.4 Product Prices include New Zealand GST at 15%.

22.5 Note that online prices may differ from trade show prices. Some sales promotions may only be available online.

 

23. 20% off Labour Day Sale

23.1 Promotion Period: The Labour Day Sale runs from October 24, 2024 from 2pm until October 29, 2024 at 2pm (NZST). 

23.2 Offer Details: Enjoy 20% off storewide during the promotional period.  Discount can't be combined with other product promotional discounts.  Free shipping still applied to NZ purchases over $150 after discount is applied.

23.3 Redemption: To redeem the offer simply purchase an item/s during the promotional period. No discount code is required.  The 20% off does not apply to shipping costs and is only applicable to products purchased.

23.4 Limitations: This offer is valid while stocks last and may be subject to change without prior notice.  WILDhue reserves the right to limit the number of items eligible for this promotion.
